Our office has been retained to represent passengers affected by this crash, and we are available to help you and your loved ones.
What caused the crash?
NTSB is still looking into the cause of the crash but reported that the train was traveling at 87 mph at the time of impact. It is possible the train was overcrowded when it reached the site of the accident. The crossing where the accident took place is uncontrolled, meaning there are no gates or flashing lights to alert motorists to an oncoming train. News reports indicate the crossing presented a well-known danger because of the lack of warning measures, the steepness of the grade, the angle of the track at the crossing, and the vegetation blocking vision.
It will be many months before we have the results of the NTSB probe, but in the meantime, Goza & Honnold is gathering evidence. We are reviewing the events of that day and examining all potential areas of negligence.
How many people were involved?
The train was carrying was carrying 12 crew members and 275 passengers at the time of the crash. The dump truck, owned by Missouri-based MS Contracting, had one occupant. Four people died, including three train passengers and the driver of the dump truck. Approximately 150 people were injured in the crash.
